Claims that the Naked Juice Company is falsely advertising its products as ‘all natural’ despite a number of synthetic ingredients, has landed the Monrovia, CA-based company with several class action federal lawsuits.
The first federal lawsuit was filed in September by a Texas resident who claims the products she purchased were falsely and deceptively marketed, including “Blue Machine” and “Green Monster.” Three more copycat lawsuits have also been filed in federal court making similar claims.
According to the first complaint filed by attorney Yvette Golan, “As a result of their false and misleading labeling, (Naked Juice was) able to sell these products to hundreds of thousands of consumers throughout the United States and to profit handsomely from these transactions.”
The ingredients in question are both synthetic and genetically modified despite being labeled as natural and non-GMO, states the plaintiffs’ claims, which they say is supported by third party laboratory testing of Naked Juice products confirming the presence of genetically modified ingredients. The synthetic ingredient in question is Fibersol-2, “a proprietary synthetic digestion-resistant fiber produced by Archer Daniels Midland and developed by a Japanese chemical company,” according to the lawsuit.
The World Health Organization defines genetically modified as creating something that would not occur naturally in the organism. Similar cases have been filed against ConAgra, maker of Wesson vegetable oil, which was marketed as natural despite being made from genetically modified ingredients.
Last month, consumer advocacy group, The Cornucopia Institute, issued a report claiming that several cereal brands promoting their products as natural were third party laboratory tested, which revealed that as much as 100 percent of some of the cereal samples tested contained genetically modified ingredients.
