Despite the 2018 federal Farm Bill that legalized hemp products including the wildly popular non-psychoactive cannabinoid CBD (cannabidiol), it seems businesses selling products containing the chemical are in danger of being shut down.
That's the news according to Eater, which reported on New York City restaurant and bakery being forced by the Department of Health to pull cookies and pastries containing CBD.
"Fat Cat Kitchen’s co-owner C.J. Holm says that officials with the health department bagged up about $1,000 worth of cannabidiol (or CBD) edibles on Friday morning during a routine inspection, putting them in a zip-lock bag and marking them as 'embargoed.' Holm is still in possession of the items," Eater notes.
“I mean, this is crazy,” Holm says city agents were unfamiliar with what CBD was and had to call into their office for more information. “They couldn’t even intelligently explain to me exactly what the problem was when I spoke to them on the phone.”
Crackdowns on legal CBD are happening in other states, too. Both Maine and Ohio, which already have legal marijuana laws on the books, have both seen state officials thwarting the sale of CBD-containing products.

Part of the issue in New York and Maine is the method of delivery. Both states prohibit CBD sold in an edible form.
“It’s like telling me I can buy rum and I can sell rum, but I can’t sell a rum baba,” Holm said.
CBD has seen a meteoric rise in the wellness category. The compound has been linked to decreased inflammation, pain management, improved sleep, and an ability to decrease stress and promote relaxation. It is also linked to the decreased occurrence of seizures--a Colorado company, Charlotte's Web, made headlines when its CBD products helped a young girl named Charlotte who suffered from Dravet syndrome. Use of CBD dramatically decreased the daily seizures caused by the condition.
